On April 29, 2024, the U.S. Equal Employment Opportunity Commission (EEOC) released final enforcement guidance on workplace harassment. According to the EEOC, the final rule serves as a “single, unified agency resource on EEOC-enforced workplace harassment law.” The EEOC’s final rule clarifies protections for LGBTQ+ workers, virtual work environments, sex-based harassment based on pregnancy or childbirth, as well as a variety of other topics. The final rule also describes the key elements necessary to prove an employer took reasonable care to prevent and correct harassment, including components of effective anti-harassment policies, complaint processes and anti-harassment training.
