Correia & Puth attorneys Linda M. Correia, Lauren A. Khouri, and Andrew M. Adelman have joined together with civil rights organizations Public Justice, and firms Wardenski P.C., and Milberg Coleman Bryson Phillips Grossman, PLLC, to challenge South Carolina’s transgender school bathroom ban.
The lawsuit challenges South Carolina’s Budget Proviso 1.120, enacted in July 2024, which prohibits transgender K-12 students from using restrooms that correspond to their gender identities. In this lawsuit, Correia & Puth represents transgender teenager John Doe, a proposed class of transgender public school students in South Carolina, and social justice organization Alliance for Full Acceptance.
John Doe has asked the court to allow him to bring this case alleging violations of the U.S. Constitution and Title IX of the Education Amendments of 1972 as a class action, so that a favorable ruling can protect all transgender students in South Carolina’s public schools.
