D.C. Council Passes Minimum Wage Clarification Bill

On December 19, 2023, the D.C. council passed the Minimum Wage Clarification Amendment Act of 2023, an amendment to the Minimum Wage Revision Act of 1992. The bill requires that employers pay D.C. minimum wage rates to any employee that performs at least two hours of work within the District in one work week.

Currently, employees are only guaranteed D.C. minimum wage rates if they spend a majority of their working hours in D.C. The bill is designed to close a loophole wherein employers can rotate employees between job sites in order to avoid paying D.C. minimum wage rates. D.C. Councilmember Janeese George stated that this bill is particularly important for construction workers, who are especially vulnerable with the current loophole in place.
